Contest Rules, Terms and Conditions

1 – Organising Company

SKYEPHARMA PRODUCTION SAS, simplified joint stock company, with share capital of €15,537,011.00, whose head office is located at 55 RUE DU MONTMURIER, 38070 SAINT-QUENTIN-FALLAVIER, FRANCE, registered under the number 409 600 616 R.C.S. VIENNE (“SKYEPHARMA”), is organising a draw, for a fixed period, under the conditions set out below.

The application for the contest will be accepted from January 11, 2024, midday, to March 31, 2024, midnight. The draw will take place on April 7, 2024.

2 – Participation

The candidatures are open to any pharmaceutical company, duly registered in its country, for the following countries : world.

The participation is strictly nominative.

SKYEPHARMA reserves the right to carry out any verification it deems necessary, in particular regarding the identity and address of each applicant, in order to ensure compliance with the stipulations of this article. In this respect, any indication that is incomplete, erroneous, falsified, does not make it possible to identify an applicant or his contact details, or contravenes one of the stipulations of these rules, will result in the cancellation of its participation.

3 – Principle and terms and conditions of the contest

SKYEPHARMA proposes you to participate in the following contest in order to win a free prototype formulation.

This contest is announced on SKYEPHARMA’s LinkedIn page and on its website skyepharma.com.

The number of the applicants is not limited.

To participate, the applicant must duly complete the form bellow. Any incomplete, illegible or late submission will be considered invalid, and the winner will not be entitled to be preselected.

SKYEPHARMA will preselect the eligible applicants on the basis of the information submitted in the following application form. SKYEPHARMA will then draw lots among these eligible applicants. The draw will take place on February 29, 2024.

The prize will be a free prototype formulation of the product reference in the form. Only one (1) prize will be granted. The winner may not claim the cash equivalent of the prize won or ask for it to be exchanged for other goods or services. The prize is nominative and may not be awarded or transferred to one or more third parties.

If you are drawn, SKYEPHARMA will contact you within ten (10) business days to announce your victory and to gather any additional information it deems useful for providing the prize. If necessary, or upon winner’s request, the winner will be invited to sign a confidentiality agreement.
If Skyepharma doesn’t contact you after this date, it means that another applicant got the prize.

SKYEPHARMA may not be held liable if the winner remains unreachable for a period of two (2) months following first contact attempt by SKYEPHARMA. After this period, the winner who remains unreachable shall be deemed to have relinquished its prize, without the liability of SKYEPHARMA being engaged thereby.

SKYEPHARMA reserves its rights to shorten, extend, modify or cancel the contest in the event of “force majeure” or in the event of exceptional circumstances beyond its control.

Any dispute or claim relating to the contest must be submitted in writing to SKYEPHARMA’s address within thirty (30) calendar days of the end of the contest, i.e. by March 30, 2024 inclusive (date as postmark). The request must include the exact contact details of the company making the request, failing which it cannot be taken into account.

4 – Protection of Personal Data

The personal data collected is necessary for organising the Contest and awarding the prizes to the winners. It is intended exclusively for use by SKYEPHARMA for the purposes of the Contest and will not be used for any other purpose, except with the consent of the applicant.
In accordance with the French Data Protection Act no. 78-17 of 6 January 1978, all participants have the right to access, modify, rectify and withdraw any personal information concerning them, which they may exercise by writing to SKYEPHARMA’s address.

5 – Applicable law

The contest and these rules are governed by French law.

Any fraud or failure to comply with these rules may result in the exclusion of the perpetrator, with SKYEPHARMA reserving the right, where appropriate, to take legal action against the perpetrator.

PARTICIPATION IN THE CONTEST IMPLIES EXPRESS AND UNRESERVED ACCEPTANCE OF ALL THE PROVISIONS OF THESE RULES AND OF THE LAWS AND REGULATIONS APPLICABLE TO GAMES IN FORCE IN FRANCE.
